In a significant legal development, Kangana Ranaut, the BJP’s Member of Parliament from Mandi, faces a legal challenge regarding her election victory in the Lok Sabha. A resident of Kinnaur, Layak Ram Negi, has filed a petition with the Himachal Pradesh High Court seeking to invalidate her election. Negi alleges that his nomination papers were unfairly rejected, which he claims would have changed the election outcome.

    Allegations of Improper Nomination Rejection

Negi, a former forest department employee who took premature retirement, contends that he submitted all required documents, including a “no dues certificate” from the forest department, along with his nomination papers to contest from the Mandi constituency. However, despite producing additional certificates from the electricity, water, and telephone departments within the stipulated timeframe, the returning officer purportedly refused to accept these documents, leading to the rejection of Negi’s nomination papers.

    Legal Notice and Response Deadline

Justice Jyotsna Rewal of the Himachal Pradesh High Court has issued a notice to Kangana Ranaut, directing her to respond to Negi’s allegations by August 21, 2024. Ranaut, who secured the Mandi Lok Sabha seat with a substantial margin of 74,755 votes over her closest rival, Vikramaditya Singh of the Congress, garnered a total of 5,37,002 votes compared to Singh’s 4,62,267 votes.

Petitioner’s Plea and Election Outcome Impact

Negi argues that had his nomination not been unfairly rejected, he could have potentially won the election. He maintains that the rejection of his papers was unjust and calls for the election results to be set aside based on these grounds.

This legal challenge underscores the complexities and scrutiny involved in the electoral process, particularly in contested elections where margins are narrow. The outcome of this case could potentially have broader implications for electoral procedures and fairness in the democratic process.

    FAQs

    1. What is the Representation of the People Act?

The Representation of the People Act is an Indian law enacted to conduct elections to the Houses of Parliament and to the House or Houses of the Legislature of each State. It regulates the electoral process to ensure free and fair elections, including provisions on the disqualification of candidates and the prohibition of corrupt practices.

    2. Could Kangana Ranaut face imprisonment?

While it’s possible, imprisonment would generally depend on the severity of the offenses proven in court. More likely are penalties such as fines or disqualification from holding public office.

    3. Has Kangana responded to the allegations?

Kangana has publicly denied all allegations, calling them politically motivated attacks meant to tarnish her reputation. She has vowed to fight the charges vigorously in court.

    4. What’s next in the legal process?

The case will proceed through the judicial system, starting with the presentation of evidence and witness testimonies. The timeline can vary, but legal experts suggest it could be months before a verdict is reached.
